We totally agree with your sentiment, but the difficulty will always be in determining who are the &#039;can&#039;t pays&#039; and who are the &#039;won&#039;t pays&#039;. This is a problem that needs preventative medicine rather than action after the event.

The majority of charging orders are used as a form of security, however it should be the creditor&#039;s decision on whether to proceed with an order for sale. Surely the costs would be the governing factor. With a ban on debts under £25,000 creditors would rely on bankruptcy as an alternative.

There needs to be a distinction between the can&#039;t pay and won&#039;t pay.</description>
